Fugitive Convicted of 6th DWI, Sentenced to 40 years, Surrenders to Authorities

Collin County District Attorney Greg Willis announced Monday that Richard Davis Callaway, 48, of Plano surrendered to the Collin County Sheriff’s Office.

Callaway was sentenced by a Collin County judge to 40 years in prison for his sixth driving while intoxicated conviction following a bench trial on Wednesday, March 7, 2012.

According to the District Attorney, Callaway had appeared in court for the start of the trial and heard all of the State’s evidence against him. After the court took a recess for lunch, Callaway never returned to the courtroom. As provided by law, State District Judge Ray Wheless completed the trial without him. After the 40-year sentence was pronounced, a warrant issued for Callaway’s arrest.

The District Attorney said Callaway remained a fugitive from justice until turning himself in this morning.
